Recognition of the General Terms and Conditions
These General Terms and Conditions set out the legal terms that apply to use of Meeliora website: www.meeliora.com as well as to concluded contracts between Meeliora and the Customer. The customer is expected to read these General Terms and Conditions carefully before placing an order. By accessing or using the Website, the customer is acknowledging that he has read, understood, and agreed, irrevocably to them. Meeliora may change or modify these General Terms and Conditions at any time, you will be bound to these changes if you order products after the new publication.
Order process and confirmation
By using www.meeliora.com you are bound by these General Terms & Conditions. All orders placed by you are subject to our acceptance. Meeliora reserves the right at all times of asking complementary information to the customer and refuse to accept an order for any reason and without liability to you. Meeliora sells products and services online. When visiting the website, the customer places the wished products on his basket. During the checkout, the customer will accept the general conditions and proceed to payment accordingly. After you have placed the order with Meeliora, you will receive an order acknowledgement by email with your order number and details of the products. However, this email does not constitute our acceptance of your order. The acceptance of your order will only take place when you have been advised the products you have ordered are available and have been fully paid. No payments are considered to be received until the full amount is collected.
Price and Payment
All prices mentioned on the website include any applicable VAT and are quoted in euro (EUR). Delivery fees are detailed separately on the checkout. Meeliora may change the prices on the website at any time and without any notice. Although we try to ensure all prices mentioned on the website are correct there may occasionally be an error and items may be mis-priced. If an incorrect price quoted on the website is lower than the correct price, we will assume that you wish to continue with your order. On the other hand, if the correct price is higher, we will contact you to ask if you wish to cancel the order. We are under no obligation to supply goods at the incorrect price. Payments can be made by bank transfer, PayPal or VISA, American Express, MasterCard. Orders will be processed only after payment of the invoice has been successfully made.The supplied products remain Meeliora property until the customer has fully paid the order amount.
The products are delivered to the delivery address provided by the customer. The delivery times indicated on the website are solely indicative. The delivery time is counted from the day of full payment of the order. In the event of import duties applicable to certain countries, it will be the customer's responsibility to pay any fee. Customer is exclusively responsible for the non-delivery or the delay of delivery due to an incomplete or erroneous address. If customer does not take delivery of the products or supply adequate delivery instructions, we may cancel the order and retain the products. If any other error or delivery problem occurs in respect of the products ordered, you must notify us in writing within 14 days after delivery. We will not be liable for any loss or damage if you fail to do this.
Customers may cancel cancel orders for items purchased from Meeliora Website any time up to 14 days from the delivery. To cancel the order, customer should notify Meeliora by email to email@example.com within these 14 days and order details, stating order number, delivery date and reason for cancellation. Returns Procedure -The products must not be unpacked, used and damaged:
-The return number provided by Meeliora must appear clearly on the package (not on the items).
-In any event damaged or used items will not be exchanged nor will a refund be made. However, if the items delivered have obvious material or manufacturing defects (including damages caused by shipping), we request these defects to be notified to us immediately.
-Customers are responsible for the fees of returning the items to Meeliora unless delivered mistakenly. Upon reception, Meeliora will contact the customer in order to proceed with reimbursement of the payment related to the products concerned. The reimbursement will be made, deducting the delivery fees. -The returns must be sent by post to the following address: Meeliora SARL (Xpress Logistics) 19 Rue de L’Industrie, L-8069 Bertrange, Luxembourg.
All deliveries will be considered in conformity with the order if no claim is placed after 24 hours of delivery. It is consumer’s responsibility to examine the delivered items as soon as they are received. We assume no responsibility for any deterioration or damage of the products after delivery. To benefit from an exchange or a refund, the customer must return the damaged or non-conforming products within 7 days of the complaint. Delivery is accepted and claim is automatically considered as withdrawn right after this deadline.Returns must be arranged following the procedure described in section “Order Cancellation”. All risk of damage to or loss of the items bought by the customer will pass to him once a product has been received. Meeliora would not be held liable in case a defective product causes any physical damage to consumers or their properties. Consumers may claim compensation for damage to the producer of the product.It is consumer’s responsibility to read labels, warnings, and directions provided with the product before using or consuming it. We have tried to ensure that information provided in the website is accurate. However, we make no representation and give no warranty of any kind in respect of the information. We reserve the right to make changes which do not materially affect the quality or performance of those products.We may correct any error appearing in the website or withdraw any product from sale without incurring liability. Price and availability is also subject to change without notice. Customer accepts and agrees by law that Meeliora shall not be liable to the customer or to any other person for any loss or damage (including consequential or indirect loss or damage), loss of revenue or profits whether direct or indirect caused and deriving from the customer use of Meeliora website and from any product the customer uses. Meeliora assumes no responsibility for the conformity of the products ordered with the legislation and /or regulations in the country of delivery.
In order to prevent abuse or fraud, Meeliora manages contractual and pre-contractual relationships by dealing with personal data related to the customer. Personal data is collected when the customer makes an order, or registers in order to open the account. The customer authorises Meeliora to carry out such processing of his data and acknowledges that Meeliora remains free to use the data regarding the execution of the activity. When the customer agrees and gives consent for the treatment of personal data, the customer is giving consent for his data to be used for commercial and marketing purposes. This information can be treated to make segmentations and profiles, and to send segmented information and offers, by electronic means about products and/or services. Customers can exercise their right to reassure and request the deletion of their personal data. Customers can do this by opting out of marketing emails at signup. All customers can unsubscribe from these emails from the Account Dashboard. Meeliora engages not to communicate the contact details about its clients to third parties without his consent. The customer has a right of access to the information concerning himself/herself, as well as modification, rectification and suppression of the data that concerns him.
The relationship between Meeliora and the customer is subject to Luxembourg law. Only the courts of the Grand Duchy of Luxembourg are responsible for any dispute between the customer and Meeliora. If any provision regarding these General Terms and Conditions is invalid, the validity of the remaining provisions shall not be affected.
